Graul v. Kansal, 2022 ONSC 1958
Jon Graul was a highly productive individual who worked in a supervisory capacity at Guelph's wastewater management plant. Jon was involved in a serious car accident in which he suffered several injuries including a mild traumatic brain injury. He went on to develop post-concussive syndrome and was unable to return to work.
Prior to trial, the Defendant had made a $350,000. Lane was one of three lawyers representing Jon at trial where the Court awarded him $2.4 million. The Court additionally awarded Jon another $1.75 million in legal costs. The cross-examinations of the Defendant insurance company's experts produced media coverage regarding expert bias.
Pastink et al v. 1190393 Ontario Limited et al., 2023 ONSC 6037
Noah Pastink was assaulted just outside of a bar and suffered a traumatic brain injury. He sued his assailant, but also the bar for improper security. The bar sought a mini-trial (summary judgment motion) where they asked the Court to rule that they were not partially at fault for Noah's injuries. Lane represented Noah at the mini-trial in this complex case where the Court refused to dismiss his claim against the bar. Shortly after the motion, the matter was settled on confidential terms.
Hardwick v Intact Insurance Company, 2023 CanLII 40077 (ON LAT)
Patricia "Patty" Hardwick suffered soft tissue injuries in a motor vehicle accident. Instead of healing, her injuries resulted in her developing chronic pain. She eventually applied for income replacement benefits with her automobile insurance company - Intact. Initially, Intact paid her income benefits, but eventually they cut her benefits as they believed she could return to some type of employment.
Lane represented Patty at an accident benefits arbitration against Intact Insurance Company. After hearing the case, the License Appeal Tribunal agreed with Patty that she was unable to work due to chronic pain. The Tribunal ordered that Intact pay the benefits it denied her with interest, and restart her benefit payments. Additionally, the Tribunal ordered that Intact pay a rarely ordered "special award" for not handling Patty's case properly. The Tribunal ordered Intact to pay an additional 10% of Patty's past benefits to her as it did not provide her expert reports to its own experts.
Legree v. Origlieri, 2021 ONSC 7650
Laura Legree was rear ended in a relatively minor car accident with modest damage to her vehicle. However, she suffered chronic pain after her accident and was eventually diagnosed as having suffered a concussion.
Prior to trial, TD insurance company had only offered Laura $1,200 to settle her case. Lane was one of two lawyers representing Laura at trial. At the end of a two week trial, the Court awarded Laura $212,000 in damages, nearly 200 times more than TD's offer to her prior to trial.
