Graul v. Kansal (2022 ONSC 1958) — Traumatic Brain Injury Trial Outcome

 

Our lawyers were part of the litigation team representing a client who sustained a concussion in a motor vehicle collision and was unable to return to work. Before trial, the insurer offered $350,000. After a five-week trial, the Court awarded the client approximately $2.4 million in damages, plus legal costs of $1.8 million. Legree v. Origlieri (2021 ONSC 7650) — Mild Traumatic Brain Injury Trial Result

We were involved in the trial team for a case in which the insurer offered only $1,200 to settle a mild traumatic brain injury claim. After a two-week trial, the Court ordered the insurer to pay over $210,000 in damages and costs. Pastink v. 1190393 Ontario Ltd. (2023 ONSC 6037) — Assault Brain Injury Litigation

LAT A22-003007 (2023 CanLII 40077) — Chronic Pain / IRB Appeal Allowed

 

We represented a client whose insurer initially denied income replacement benefits and offered no settlement, despite chronic pain and an inability to work. After a contested hearing before the Licence Appeal Tribunal, the adjudicator found the client met the disability test and awarded income replacement benefits. This case demonstrates our experience challenging improper benefit denials, particularly in chronic pain and invisible-injury claims.

 

Motor Vehicle Collision — Soft Tissue & Psychological Injuries Resolved for Significant Compensation
